13.1 Patents of Non-NASA Associates

13.1.1 -- Any patentable inventions or ideas that result from research activities during your tenure will come under the purview of existing arrangements between the Research Council and the United States government.

13.1.2 -- You are required to report all such inventions promptly to the director of the laboratory, and, unless the invention involves classified information, to send a copy of the report to the Program Administrator. The report must include the title of the invention, the assigned case number, and the name of the patent counsel at the sponsoring laboratory.

13.1.3 -- If the US government or the Research Council elects to file a patent application on any invention made by you during your tenure or arising from it, you are expected to assist in preparing the patent application.

13.1.4 -- If patented by the Research Council, the federal government would retain royalty-free rights during the life of the patent, and the Research Council and the inventor would negotiate the division of any income resulting from the practice of the patent.

13.2 Publications of Non-NASA Associates

13.2.1 -- You are encouraged by the Research Council and the sponsoring laboratory to promptly publish all unclassified scientific results in the normal outlets for such publications.

13.2.2 -- A need exists for a reasonable review by the laboratory to protect against inadvertent, unauthorized disclosure of classified or proprietary information. You must conform to the laboratory's requirements for prior review and approval of all material, whether written or prepared for oral presentation.

13.2.3 -- All publications should include appropriate acknowledgment to the Research Council and the laboratory as follows:

This work was performed while the author held a National Research Council-(laboratory name or acronym) Research Associateship.

13.3 Patent and Copyright of NASA Associates

Any invention that results from research activities during your tenure as a NASA Associate will come under the purview of the "Agreement -- Disposition of Rights in Patent and Copyright," which you signed when starting tenure.

13.4 Patents of NASA Associates

13.4.1 -- Generally, you have the right to retain title to inventions that arise as a consequence of, or in direct relation to, your tenure as a guest researcher. If you choose not to file for patent protection, you thereby agree to assign your rights in the invention to the federal government.

13.4.2 -- For each invention to which an Associate retains title, the federal government will obtain, at a minimum, a nonexclusive, nontransferable, irrevocable, paid-up license to practice, or have practices for or on behalf of the United States.

13.4.3 -- The National Research Council will not obtain any rights to your inventions.

13.5 Copyright of NASA Associates

13.5.1 -- You are encouraged by the Research Council and the sponsoring NASA Center to promptly publish all unclassified scientific results of your research in the normal outlets for such research results, whether you assert copyright in the work or not.

13.5.2 -- If you assert copyright in the written works that arise from your research activities, the federal government and others acting on the government's behalf will obtain a paid-up license to reproduce the copyrighted work, distribute copies, prepare derivative works, perform publicly the copyright work, and display publicly the copyrighted work.

13.5.3 -- Joint works will be jointly owned by the Associate and NASA.

13.5.4 -- All publications should include appropriate acknowledgment to the NASA Center and the Research Council as follows:
