many invalid patents in software; indeed, Mr. Goldstein said that some software patents may be declared invalid for “obviousness reasons.” The Patent Office lacks the manpower and databases to understand the range of products and innovations in software. However, it is not an industry-wide phenomenon where software firms file for patents, which they suspect are invalid, as a strategy to hold back technical progress by other firms.
