the search itself usually has been upheld, but questions frequently have been raised regarding the screening procedure used in individual cases. Air carriers and contracting companies would benefit from technologies that issue fewer false alarms and more specific alarms to allow personnel to resolve alarms without gaining irrelevant information. New performance criteria, which require the use of new technologies, may
be of concern to the FAA if the only way air carriers can satisfy the new criteria would be to violate an individual's rights under the Fourth Amendment. In that case, the FAA may be enjoined from mandating such performance criteria. The FAA must also ensure that new performance criteria are reasonable and consistent with the statutory authority of the FAA to impose such measures.
