ADA Paratransit Eligibility Appeal f King County Metro finds you ineligible or conditionally eligible for ADA paratransit services, you have the right to appeal when you do not agree with that determination. ADA Paratransit Services are provided by Access Transportation in King County. By federal law, an independent party must handle your appeal. Harborview Medical Center is the appeal administrator for King County Metro. There are two steps to the appeal process. Need this information in an alternate format? First step: After receiving a notification of ineligibility or conditional eligibility, within 60 days you may send a brief letter to King County Metro stating you intend to appeal and the reasons for your appeal. Send the letter to: Access Paratransit Eligibility Appeals King County Metro Accessible Services, KSC-TR-0200 201 S Jackson St Seattle, WA 98104-3854 You may also provide your intent to appeal by phone or email at: 206-263-3113 (TTY Relay: 711) accessible.services@kingcounty.gov Second step: Within 30 days of the date your letter reaches King County Metro, you will be contacted to set up either an appeal evaluation or an appeal hearing, depending on your original evaluation. An appeal evaluation is conducted by a different evaluator than your original evaluation. Evaluations (plus transportation to and from the appointment) will be conducted at Harborview at no cost to you. You will be notified by mail of the results after the appeal evaluation is completed. If you still do not agree with the decision, you may follow the directions in “First step” to request an appeal hearing. An appeal hearing will be held at Harborview Medical Center. • You may send written information or participate via a telephone conference call. • You may also attend the appeal hearing at Harborview. If you attend the appeal hearing, you may bring another person with you. Braille material, voice amplification, a sign language interpreter, or other aids or services you may require will be provided at no cost to you if you request them at the time you make the appointment. Within 30 days of the appeal hearing, the appeal administrator will make the final eligibility determination and notify you in writing. If you are found ineligible or conditionally eligible after the appeal hearing, you may reapply for ADA paratransit eligibility any time your condition changes.

TRB's Transit Cooperative Research Program (TCRP) Synthesis 133: Administration of ADA Paratransit Eligibility Appeal Programs identifies ADA eligibility appeal processes and documents current practices of transit systems.

ADA paratransit eligibility appeal programs allow appellants the opportunity to present new information not provided or available during the initial eligibility decision that may warrant a change in eligibility determination. At the same time, any appeal program must consistently apply the decision-making standards established by the agency’s ADA paratransit certification program. As more agencies employ some form of conditional eligibility, eligibility appeal processes are emerging as a significant area of vulnerability. If the eligibility appeal process is not administered properly, transit agencies run the risk of violating applicants’ civil rights under the ADA or Title VI requirements.

Although several reports describe transit agency practices for determining eligibility for ADA paratransit service, little has been documented about how transit agencies manage appeals by applicants who are determined to be “not eligible” or who are found “conditionally eligible,” including temporary eligibility.
